MonetizeAI Terms of Service

Welcome to MonetizeAI, a platform owned and operated by Alaivi Ltd, registered in the United Kingdom ("we", "us", "our"). These Terms of Service ("Terms") explain your rights and responsibilities when using MonetizeAI (the "Platform").

By accessing or using the Platform, you agree to these Terms. If you don’t agree, please don’t use MonetizeAI.

1. Who Can Use MonetizeAI

You must be at least 18 years old to use the Platform.

2. What MonetizeAI Does

MonetizeAI is a no-code platform that lets you:

Build and publish AI agents
Monetise agents via subscriptions
Discover and use other people’s agents

We may change or improve features over time.

3. Your Account

You must provide accurate, up-to-date information when registering.
Keep your login details secure — you're responsible for anything that happens under your account.
We may suspend or remove accounts that provide false information or breach these Terms.

4. Earnings, Payments, and Fees

4.1 Creator Earnings

If you monetise your agents, you'll receive payouts through a third-party provider (e.g., Stripe). You may need to verify your identity or payment details to receive earnings.

4.2 Platform Fees

We charge a 15% commission on creator earnings.
An 8% buyer fee applies to purchases.
We may update fees in future, and we’ll let you know if we do.

4.3 Refunds

All refunds are granted at our discretion. Users must not file chargebacks without our prior approval.

4.4 Cancelling Subscriptions

You can cancel subscriptions anytime. Refunds are not guaranteed unless required by law or explicitly offered.

5. AI Agent Ownership and Licensing

5.1 Your Rights

You retain ownership of the original content and data you upload to create your AI agents.

5.2 Our Rights

By listing or publishing an agent on the Platform, you grant Alaivi Ltd a non-exclusive, worldwide, royalty-free licence to:

Host and display the agent
Promote your agent on and off the platform
Use anonymised data from your agent to improve our services

5.3 Templates and Discoverability

Public or monetised agents may be reused as templates or base models by other users. We may highlight or feature these agents across the Platform and in our marketing.

6. Your Content and Conduct

You are responsible for all content you upload or create.
You must not upload harmful, abusive, misleading, or illegal content.
Don’t impersonate others, mislead users, or misuse the Platform.
Don’t reverse-engineer, scrape, or clone our systems.
Don’t bypass our token systems or payment infrastructure.

7. AI Agent Limitations

AI agents are powered by third-party tools and large language models.
They may sometimes provide inaccurate, misleading, or offensive content.
You must not use agents to provide legal, financial, or medical advice without clearly stating that outputs are AI-generated and may be inaccurate.

8. Third-Party Tools and Integrations

Some agents and features rely on third-party APIs or services. These are provided "as is".
We’re not liable for errors, outages, or issues caused by third-party providers.

9. Platform Availability

We aim for high uptime, but we don’t guarantee uninterrupted service.
We’re not responsible for losses due to downtime, bugs, or outages.

10. Account Closure and Removal

You can request to close your account at any time. However, we may delay or deny closure if:

You owe outstanding fees
You have active agents or unresolved transactions
There’s an ongoing investigation

We may also suspend or permanently remove accounts that break these Terms.

11. Limiting Our Liability

To the extent allowed by law:

We’re not liable for losses from use of AI agents or platform errors
We’re not liable for issues with third-party integrations
Our total liability is capped at the amount you paid us in the six months before a claim

12. Indemnity

You agree to protect Alaivi Ltd and its team against any claims, losses, or legal action that result from:

Your use of the Platform or any agents
Your breach of these Terms
Any misuse or reliance on AI-generated outputs

13. Privacy

Your data is handled according to our Privacy Policy. We use cookies and analytics to improve your experience. We may use anonymised data for training or analysis purposes. Personal data is not used for AI training.

14. Updates to These Terms

We may change these Terms from time to time. If we do, we’ll let you know. Continuing to use MonetizeAI means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales, unless your local laws say otherwise.

16. Dispute Resolution

Please reach out to us first to try resolving any issues. If that doesn’t work, disputes will be handled via binding arbitration under UK law unless stated otherwise by your jurisdiction.
